BUY AMERICA(N) Act of 1933

NLS Lighting supports your efforts to comply with the Buy American Act of 1933 (BAA) specifications. The BAA prohibits the Federal government from buying non-domestic goods by installing a preference for domestically manufactured goods. The BAA applies to Federal purchases that go beyondthe threshold of micro-purchases and are beneath the dollar limit for Trade Agreement Act (TAA) applicability.*

Should you receive funding from this program, it is your responsibility of identifying and complying with the applicable domestic requirements, e.g., BAA, TAA or Buy America. The applicable requirement is usually identified in the RFP/project documentation.

Understanding the Difference Between BAA and BABA

The Buy American Act, enacted in 1933, governs direct federal government procurement and contracts. It applies when federal agencies purchase supplies, materials, or equipment for their own use and generally requires a minimum level of domestic content in manufactured products. Current requirements call for 65% domestic component cost, increasing to 75% by 2029.

The Build America, Buy America Act (BABA), enacted in 2021 as part of the Infrastructure Investment and Jobs Act (IIJA), applies to federally funded infrastructure projects such as roads, bridges, water systems, broadband networks, public transit, and utilities. BABA generally requires 55% domestic content for manufactured products and mandates that iron, steel, and construction materials used in covered projects be produced in the United States.
